‘The average Detroiter would be arrested’

DETROIT (WXYZ) — Twenty-four hours after news broke of the Detroit Lions wide receiver’s near arrest, Jameson Williams, a local criminal defense attorney and Detroit police commissioner, said “the average Detroiter would have been arrested” if they had Williams’ shoes.

The star wide receiver contacted police after midnight on Oct. 8 when officers pulled over a vehicle driven by Williams’ brother near the corner of Conner Street and Jefferson Avenue. Police said the vehicle was stopped for speeding.

When questioned by a police officer, Williams’ brother revealed that two guns were found in the car: The first was in the backseat, and the second was under Williams’ seat, according to police.

Officers determined that the gun in the backseat was registered to Williams’ brother, who had a concealed pistol permit (CPL).

Although the gun under Williams’ arm was registered to him, he did not have a CPL. An officer handcuffed Williams and planned to arrest him, but after a sergeant was notified that Williams was in custody, it was decided to release him and return his gun.

“I’m pulled over, I have a gun under my arm, I don’t have a driver’s license, I’m being charged,” said criminal defense lawyer Anjali Prasad. “Actually, I will go to jail that night.”

Prasad was defending and prosecuting citizens accused of carrying concealed weapons. He worked for the Philadelphia District Attorney’s Office for 15 years, then spent four years with the U.S. Attorney’s Office in Detroit.

“You need a (concealed handgun permit) in Michigan. “You need a license to carry a concealed handgun,” he said. “And I have to say, it’s not that hard to get.”

To obtain a CPL, an applicant must undergo gun safety training as well as pass a background check. Prasad says it’s a simple but important process.

“What happens if there is a car accident and it turns hostile? What happens if there is a fight in traffic? Prasad asked. “I think the idea is, citizens, show us that you’re responsible… because then we can feel a little bit better about ourselves as a state when you’re walking around with your gun.”

Williams’ attorney, Todd Flood, said Williams believed his brother’s gun permit would also apply to the wide receiver’s gun, so it was legal for Williams to have the gun in the car.

Detroit Police Commissioner Ricardo Moore helps oversee the department and says he’s pleased the department has launched an internal investigation into the stop.

“The average Detroiter would have been arrested,” Moore said. “Detroit police officers arrest people with guns every day. They are doing good work. “This situation is different.”

Late last week, the Detroit Police Department submitted a search warrant request to the Wayne County Prosecutor’s Office.

At an unrelated news conference Wednesday, prosecutor Kym Worthy and police Chief James White were asked questions about the case.

“We just received this arrest warrant request. “We’ve got to take a look at it and handle it like we would any other case and see if we can blame it,” Worthy said. “And if we can charge, how much can we charge. We don’t know that right now.”

More reaction to Jameson Williams’ incident with DPD

White said the matter was being investigated by internal affairs and declined to comment further.

While conducting DPD’s internal investigation into the stop, 7 News Detroit learned that authorities requested and took Williams’ gun as part of the investigation.

The NFL issued a statement Wednesday saying the Lions had notified the league about the Williams incident and would have no further comment.
