Why automatic flight refunds will likely remain the rule under Trump

play

  • The Biden administration has enacted several consumer protection measures for air travelers, including automatic refunds for canceled flights.
  • It’s unclear whether the Trump administration will reverse these regulations, but experts say it may not be easy.
  • Most of the new rules were mandated by Congress with bipartisan support in the FAA reauthorization bill.

When a new assistant moves into the White House, the way the government is run changes. Under the Biden administration, the Department of Transportation has enacted a number of new consumer protections, including: automatic repayments policies regarding canceled flights and family seating, as well as increasing enforcement against airlines that violate their own terms of service.

As Washington prepares for Trump’s second term as president, travelers may be wondering what will happen to these recently enacted regulations. While it’s true that Republican administrations have generally favored fewer rules for companies, experts say there’s no guarantee the Trump administration will ease those policies, to which Americans across the political spectrum have responded positively. Even if the new DOT secretary wants to get rid of them, doing so may not be easy in many cases.

“There’s a big difference between fighting for a new rule and trying to overturn an existing rule. I would caution anyone considering overturning the new automatic refund rule,” said William J. McGee, Senior Specialist for Aviation and Travel. The American Economic Liberties Project told USA TODAY in an interview. “There may be a perception that once some of these rules are enacted, we can undo it with the flick of a pen, but it’s not that simple, especially if it’s been enacted by Congress.”

Many of the recently enacted air traveler protections were mandated by Congress in one way or another; Many were required by the latest Federal Aviation Administration reauthorization legislation, which passed with bipartisan support from both houses of the legislature.

Here are some of the recently enacted and proposed airline regulations:

  • Automatic refunds for canceled and delayed flights: necessary Reauthorized by the FAA and fully implemented on October 28
  • Free adjacent seating for families: DOT yet We ended this rulebut the FAA’s reauthorization includes a requirement for this; Therefore, the new administration will need to complete the process currently ongoing
  • More transparency on fringe benefits: The last rule was enacted In April, however, airlines sued DOT On the offer in May

The automatic refund rule will pass its first major test during the winter holidays this year and will likely quickly become popular with travelers, McGee said.

“Customers are aware of this now,” he said. “Shame on anyone who wants to take this away because they’re going to have a big fight on their hands, and I don’t just mean consumer advocates. I mean the public at large.”
