The Mount Rushmore State ballot initiative would protect abortion in the first trimester, or the first 13 weeks of pregnancy. It also provided protection in emergency situations, including when pregnancy in the third trimester poses a risk to the life of a pregnant person. The measure would restrict regulations that could apply to second-trimester pregnancies, stating that the government could only intervene in a manner “reasonably related to the physical health of the pregnant woman.”

Nebraska had two simultaneous abortion-related measures on the ballot, one in favor and the other against. In the early hours of Wednesday, Associated Press calling the race in favor of the ban, reporting that the state’s residents had voted in favor of an amendment banning abortion after the first trimester of pregnancy (effectively upholding the state law) and rejected a proposal that would have guaranteed the right to abortion until viability.

Three states that failed to pass abortion initiatives on Tuesday signal a small shift toward an increasingly conservative outlook across the country. In the two years since the Supreme Court overturned Roe v. wadeAbortion efforts won in every state where the issue was on the ballot. But Florida’s effort faced particularly tough challenges: It needed 60 percent of the votes to succeed for an amendment to the state constitution.
