Cooper’s bail hearing was held by telephone Friday with Judge Penny Freesemann presiding.

The prosecution requested that Cooper’s bail request be denied. They said Cooper was present at the time of the mass shooting. out of bond Charges of theft by receiving stolen property, possession of a firearm during the commission of a felony and possession of a controlled substance were included in a separate case. They say bail conditions in that case require him not to possess a firearm and to be kept under house arrest, although he does not have to wear an ankle monitor.

The defense argued that Cooper had no criminal convictions and was not a flight risk. They added that in the other case, the State should have taken action to revoke Cooper’s bail, but had not done so in the five months since the Ellis Square shooting.
