The Marion County State’s Attorney’s Office has charged a 33-year-old Salem man with both burglary and felony retail theft after he was allegedly found hiding in a bathroom after the Farm Fresh Market in Salem closed.

Adam Durham, of West Spruce Street, is believed to have hid in the store at closing time and took food from the shelves after everyone else had left. After the burglar alarm went off, police searched the building and allegedly found Durham eating some of the food while hiding in the bathroom. He also reportedly bought another bag of groceries from the store sitting next to him.

Durham, who made his first court appearance Thursday afternoon, was released on pre-trial conditions that included having no contact with Farm Fresh Market. Durham was also arrested in Marion County on a misdemeanor warrant for failure to serve an arrest warrant in connection with another retail theft case.

The preliminary hearing was scheduled for December 5.
