Bar association presidents warned lawyers against meaningless election lawsuits

Former presidents of the American Bar Association and other state and local bar associations published an open letter condemned election lawsuits filed in swing states across the country.

“As past presidents and presidents of local and national bar associations, this flurry of litigation forces us to remind the profession and the public that the courtroom is not the scene of false allegations,” the letter said.

“When lawyers bring a case, we have a duty to ensure that it is based on concrete facts, supported by law, and free from any intent to waste or harass the court’s time,” the group of more than 100 former presidents wrote. “An unfounded lawsuit not only wastes judicial resources but also undermines the public’s trust in our democracy and our profession.”

“Lawyers who ignore these standards risk not only their careers but also the credibility of the entire legal system, undermining the democracy we are sworn to protect,” the group wrote. “As legal professionals, we must hold ourselves to the highest ethical standards to prevent a recurrence of these events. With this election, we call on our colleagues to remember our duties as lawyers and guardians of the rule of law.”

The short letter included four and a half pages of signatures from the organization’s past national, state and local presidents. This effort was supported by the efforts of the baron. American Democracy Task ForceIt was established in 2023 to encourage legal professionals to protect the Constitution and strengthen the nation’s democracy.

This year, the group went on listening tours across the country to hear from advocates at the local level.
