SEC climate rule unlikely to survive Trump victory

Former President Donald Trump’s victory next week would likely overturn a years-long federal effort to require public companies to disclose threats from climate change.

However, Vice President Kamala Harris’s win does not guarantee that the controversial plan will come true.

Securities and Exchange Commission finalized climate risk disclosure rule in March — but then putting it on hold in the middle of intense litigation It is now before a conservative-dominated appeals court. But even if the courts uphold the rule, a potential Trump administration could take a number of steps to ensure the rule never takes effect or is short-lived, experts say.

“If there is a Trump victory, the rule probably will not survive,” said Allison Herren Lee, the Biden-era SEC commissioner who began the process of proposing the rule in 2021.
